Welcome to Byrge! By using our service, you agree to these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using Byrge, you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree to these terms, please don't use our service.
2. Eligibility
You must be at least 13 years old to use Byrge (or 16 years old in certain European countries where required by local law). By using our service, you represent that you meet this age requirement. If you're under 18, you should have your parent or guardian's permission.
3. Your Account
When you create an account, you agree to:
- Provide accurate and complete information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
We reserve the right to suspend or terminate accounts that violate these terms.
4. Your Content
Ownership: You retain ownership of the content you create on Byrge (places, collections, photos, descriptions). We don't claim any ownership rights over your content.
License: By posting content, you grant us a non-exclusive, worldwide license to use, display, and distribute your public content as part of providing our service. This license ends when you delete your content or account.
Responsibility: You are responsible for your content. Don't post anything you don't have the right to share.
5. Prohibited Uses
You agree not to:
- Violate any laws or regulations
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate others or misrepresent your affiliation
- Upload viruses or malicious code
- Spam or send unsolicited messages
- Scrape or collect data from our service without permission
- Interfere with the proper functioning of our service
- Attempt to gain unauthorized access to our systems
- Use our service for commercial purposes without our consent
6. Intellectual Property
Byrge and its original content (excluding user content), features, and functionality are owned by Byrge and protected by intellectual property laws. Our name, logo, and branding may not be used without our written permission.
7. Third-Party Services
Our service may contain links to third-party websites or services (like Google Maps). We are not responsible for the content or practices of these external sites. Your use of third-party services is at your own risk.
8. Disclaimer of Warranties
Byrge is provided "as is" and "as available" without warranties of any kind, either express or implied. We don't guarantee that our service will be uninterrupted, secure, or error-free. We don't warrant the accuracy of any information provided through our service, including place recommendations.
9. Limitation of Liability
To the maximum extent permitted by law, Byrge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our service.
Our total liability for any claims arising from or related to these terms or our service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) EUR 100.
10. Changes to Service
We reserve the right to modify, suspend, or discontinue our service (or any part of it) at any time, with or without notice. We won't be liable to you or any third party for any modification, suspension, or discontinuation.
11. Changes to Terms
We may update these terms from time to time. We'll notify you of significant changes by posting the new terms on this page. Your continued use of Byrge after changes constitutes acceptance of the new terms.
12. Termination
You may stop using our service at any time. We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties.
13. Governing Law
These terms are governed by the laws of the Republic of Kazakhstan. Byrge is operated by a company registered in Kazakhstan.
However, if you are a consumer in the European Union, you retain all rights granted to you under GDPR and mandatory consumer protection laws of your country of residence. For UK residents, your rights under UK GDPR and UK consumer protection laws remain fully protected. Nothing in these terms affects your statutory rights as a consumer.
14. Indemnification
You agree to indemnify, defend, and hold harmless Byrge and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these terms, your content, or your use of our service.
15. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
16. Dispute Resolution
If you have a dispute with us, please first contact us at legal@byrge.io and we will attempt to resolve the dispute informally.
If we cannot resolve the dispute informally within 30 days, any legal proceedings shall be conducted in accordance with the Governing Law section above. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access.
17. Severability
If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect and enforceable.
18. California Privacy Rights (CCPA)
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA):
- Right to Know: You can request information about the personal data we collect, use, and disclose
- Right to Delete: You can request deletion of your personal data
- Right to Opt-Out: We do not sell personal information, so this right does not apply
- Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights

19. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices published by us on the service, constitute the entire agreement between you and Byrge concerning your use of our service. These terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter of these terms.
20. Assignment
You may not assign, transfer, or sublicense any of your rights or obligations under these terms without our prior written consent. We may assign, transfer, or sublicense any or all of our rights and obligations under these terms without restriction and without notifying you.
21. Waiver
Our failure to enforce any right or provision of these terms shall not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Any waiver of these terms must be in writing and signed by us to be effective.
22. Notices
We may provide notices to you by:
- Email: To the email address associated with your account
- In-app notification: Through our service interface
- Website posting: By posting on our website or service
You are responsible for keeping your email address current. Notices sent to your email address will be considered received when sent, regardless of whether you actually receive them. For significant changes to these terms, we will make reasonable efforts to provide advance notice.
23. Class Action Waiver
For users in the United States: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Byrge.
This class action waiver does not apply where prohibited by law, including for users in the European Union and other jurisdictions where such waivers are not enforceable.
24. DMCA Copyright Policy
We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of alleged copyright infringement.
Filing a DMCA Notice:
If you believe that your copyrighted work has been copied and is accessible on our service in a way that constitutes copyright infringement, please send a notice to our designated agent with the following information:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it (e.g., URL)
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Counter-Notification:
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification with: (1) your signature, (2) identification of the removed material, (3) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake, and (4) your consent to the jurisdiction of federal court in your district. We may restore the material after 10-14 business days unless the complainant files a court action.
25. Binding Arbitration
For users in the United States: You and Byrge agree to resolve any disputes through binding individual arbitration rather than in court, except for disputes that qualify for small claims court.
Arbitration Rules:
- Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- The arbitration will be conducted in English
- The arbitrator's decision will be final and binding
- Judgment on the arbitration award may be entered in any court with jurisdiction
Opt-Out Right:
You may opt out of this arbitration agreement by sending written notice to legal@byrge.io within 30 days of creating your account. Your notice must include your name, account email, and a clear statement that you wish to opt out of arbitration.
Exceptions: This arbitration agreement does not apply to: (1) disputes in small claims court, (2) enforcement of intellectual property rights, or (3) users in jurisdictions where arbitration agreements are not enforceable (including the EU/EEA).
26. Virginia Consumer Data Protection Act (VCDPA)
If you are a Virginia resident, you have specific rights under the Virginia Consumer Data Protection Act:
- Right to Know: Confirm whether we are processing your personal data and access that data
- Right to Correct: Correct inaccuracies in your personal data
- Right to Delete: Delete personal data you have provided or we have obtained
- Right to Data Portability: Obtain a copy of your personal data in a portable format
- Right to Opt Out: Opt out of targeted advertising, sale of personal data, or profiling
To exercise these rights, contact us at privacy@byrge.io. We will respond within 45 days. If we decline your request, you may appeal by contacting us. We do not sell personal data or use it for targeted advertising.
27. Colorado Privacy Act (CPA)
If you are a Colorado resident, you have the following rights under the Colorado Privacy Act:
- Right to Access: Confirm whether we are processing your personal data and access that data
- Right to Correct: Correct inaccuracies in your personal data
- Right to Delete: Delete personal data you have provided
- Right to Data Portability: Obtain your personal data in a portable, readily usable format
- Right to Opt Out: Opt out of targeted advertising, sale of personal data, or profiling that produces legal or significant effects
To exercise these rights, contact us at privacy@byrge.io. We will respond within 45 days. If we decline your request, you may appeal, and we will respond to your appeal within 45 days. We do not sell personal data or use it for targeted advertising.
